Welcome to TowerVital, operated by Hightower Fitness Solutions LLC. By using our website and mobile application, you agree to these Terms of Service.

1. Service Description

TowerVital provides AI-powered fitness coaching, personalized daily plans, health score tracking via wearable devices, and community features. Our service is designed for informational and educational purposes and is not a substitute for professional medical advice.

2. Medical Disclaimer

TowerVital is a fitness and wellness tool, not a medical device. Our health scores, AI coaching, and fitness plans are not medical advice. Always consult a qualified healthcare provider before starting any exercise program, especially if you have pre-existing health conditions. If you experience any adverse symptoms during exercise, stop immediately and seek medical attention.

3. Account Registration

You must be at least 18 years old to create an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.

4. Subscriptions & Billing

TowerVital offers a 30-day free trial. After the trial period, continued access requires an active subscription. Subscriptions are billed monthly through Stripe. You may cancel at any time, and your access will continue through the end of your current billing period. No refunds are provided for partial months.

5. Apple HealthKit Integration

TowerVital integrates with Apple HealthKit to read health data (sleep, heart rate, HRV, activity). You must explicitly grant permission for this access, and you can revoke it at any time through iOS Settings or the TowerVital app. We use this data solely to provide core app functionality as described in our Privacy Policy.

6. AI Coach

Our AI coach provides general fitness, nutrition, and recovery guidance. Responses are generated by artificial intelligence and may not always be accurate or appropriate for your specific situation. Use your own judgment and consult professionals for specific medical, nutritional, or training concerns.

7. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Share your account with others
• Scrape, copy, or redistribute our content
• Post harmful or inappropriate content in community features

8. Intellectual Property

All content, features, and functionality of TowerVital are owned by Hightower Fitness Solutions LLC and are protected by copyright and other intellectual property laws.

9. Limitation of Liability

TowerVital and Hightower Fitness Solutions LLC are not liable for any injuries, health issues, or damages arising from the use of our service, including but not limited to following AI-generated fitness plans or relying on health scores. Use our service at your own risk.

10. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time, which will result in permanent deletion of your data within 30 days.

11. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the updated terms.
